1. INTRODUCTION

1.a. We invite you to review the general conditions governing the services offered by Casa Rural Entrebosques (Abel Enrique Elias Ruiz) through the web casaentrebosques.com as well as the use of the site. By using this website you are bound by these Conditions, Privacy Policy and Legal Notice, so we recommend that you read these Conditions carefully.

1.b. These General Conditions, together with the Special Conditions that may be established, are intended to regulate both the provision of information and commercial relations arising between Entrebosques, with NIF 16556082S and address at Calle El Bercolar, 7, El Rasillo (La Rioja) (hereinafter ‘Entrebosques’), and third parties (hereinafter ‘Users’) who use the Internet portal ‘www.casaentrebosques.com’ (hereinafter the ‘Portal’) owned by Entrebosques.

1.c. The present General Conditions have been elaborated in accordance with the established in the following norms:

  • Law 7/1998 on General Conditions of the contracting.
  • Royal Decree 1906/1999 which regulates telephone or electronic contracting with general conditions in development of article 5.3 of Law 7/1998.
  • Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.

1.d. By the mere browsing and/or use of the Portal you acquire the status of User of the same. The navigation through the Portal, the use of the same and / or the consultation of any of its products (hereinafter ‘the Products’), means your acceptance, as a User, without reservations of any kind, of each and every one of the General Conditions and the Special Conditions governing the acquisition of the Products.

1.e. Entrebosques may, at any time and without prior notice, modify the presentation and configuration of the Portal, as well as these General Conditions or, where appropriate, the Special Conditions and introduce new conditions of use. These modifications will be published on the corresponding site of the Portal so that the User may be aware of them before using the Portal. The use of the Portal once the General Conditions have been modified or, where applicable, the Specific Conditions that may be applicable, shall mean the acceptance by the User of the General or Specific Conditions thus modified.

4. DATA PROTECTION POLICY

4.a. 5. INTELLECTUAL AND INDUSTRIAL PROPERTY

5.a. The User acknowledges that all elements of the Portal and each of the Products, information and materials contained therein, trademarks, structure, selection, arrangement and presentation of its contents, and computer programs used in connection with them, are protected by intellectual and industrial property rights of Entrebosques or third parties, and that the use of the Portal does not attribute with respect to such intellectual and industrial property rights any rights other than those specifically provided for in them.

5.b. Unless expressly authorized by Entrebosques or where appropriate by third party holders of the corresponding rights, or unless it is legally permitted, the User may not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, loan, make available, or allow access to the public through any form of public communication of any of the elements referred to in the preceding paragraph. 6. RESPONSIBILITY

6.a. Entrebosques will only be responsible for the damages that the User could suffer as a consequence of the use of the Portal when these damages are attributable to a fraudulent action of Entrebosques. The User recognises and accepts that the use of the Portal, as well as the acquisition of the Products offered in it, is carried out under his entire risk and responsibility.

However, Entrebosques cannot guarantee that unauthorised third parties can have knowledge of the characteristics and circumstances of the use that users make of the Portal. To the extent permitted by law and the User’s statutory rights as a consumer, Entrebosques will not be liable for economic loss (including loss of income, data, profits, contracts, business or anticipated savings) or loss of goodwill or reputation or loss of special or indirect damages suffered or incurred by the User arising out of or in connection with these Conditions.

6.i. Entrebosques will not be liable for any failure or delay in the performance of any of its obligations under these General Conditions, which are attributable to a Force Majeure Event. The obligation of Entrebosques will be suspended during the period in which the Cause of Force Majeure continues, and it will have a suspension in the term to fulfil the obligations acquired during this period.

Force Majeure shall be understood to be any act, event, failure to exercise, omission or accident beyond the reasonable control of Entrebosques, and shall include in particular, but not limited to, the following:

  • Strikes, lockouts or other industrial action.
  • Civil commotion, riot, invasion, terrorist attack or terrorist threat, war (whether declared or not) or threat or preparation for war.
  • Fire, explosion, storm, flood, flood, earthquake, subsidence, epidemic or any other natural disaster.
  • Inability to use trains, ships, aircraft, motor transport or other means of transport, public or private.
  • Impossibility of using public or private telecommunications systems.

8. APPLICABLE LEGISLATION

8.a. The provisions contained in these General Conditions and in the Special Conditions shall be governed by and interpreted in accordance with Spanish law, which shall be applicable in all matters not provided for in these Conditions in terms of interpretation, validity and execution.

8.b. Unless expressly prohibited by law, for the resolution of all litigious matters arising from these General Conditions and the Specific Conditions or in the acquisition of the Products, or relating to the breach, interpretation, termination or validity of any provision of the Portal, the parties, by mutual agreement, submit to the jurisdiction of the Courts and Tribunals of Logro帽o, expressly waiving any other jurisdiction to which they may be entitled, as the case may be.
